TERMS & CONDITIONS (YUMIE™ Smart Fuel)
1. Introduction
These Terms and Conditions (“Terms”) govern your use of the YUMIE™ Smart Fuel website, products, and services. By accessing or purchasing from this website, you agree to be bound by these Terms in accordance with the Electronic Communications and Transactions Act 25 of 2002 (ECTA).
2. Nature of Product
YUMIE™ Smart Fuel is a nutritional yogurt-based product intended for general consumption.
- The product is not a medicine and makes no medical or therapeutic claims.
- The product is not currently approved by SAHPRA (South African Health Products Regulatory Authority).
- All ingredients and nutritional information are accurately reflected on the product label.
3. No Medical Advice or Guarantees
YUMIE™ Smart Fuel:
- Does not guarantee any specific health outcomes
- Should not be used as a substitute for professional medical advice
- Is consumed at the customer’s own discretion
4. Product Handling & Consumer Responsibility
The customer agrees:
- To follow all storage and consumption instructions
- Not to consume products past their expiry date
- To ensure proper refrigeration where required
⚠️ YUMIE™ shall not be liable for:
- Improper storage
- Consumption of expired products
- Misuse or unintended use
5. Manufacturing & Packaging Disclaimer
Products may be:
- Packed via licensed contract manufacturers, or
- Assembled in a controlled home-based environment
All reasonable care is taken to ensure:
- Hygiene standards
- Ingredient integrity
- Product safety
However, by purchasing, the customer acknowledges and accepts this production model.
6. Limitation of Liability
To the maximum extent permitted by the Consumer Protection Act 68 of 2008:
YUMIE™ shall not be liable for:
- Any indirect, incidental, or consequential damages
- Allergic reactions where ingredients are clearly disclosed
- Any misuse of the product
7. Indemnity
The customer agrees to indemnify and hold harmless YUMIE™, its owners, employees, and suppliers against any claims arising from:
- Improper use
- Failure to follow instructions
- Consumption contrary to guidelines
8. Intellectual Property
All branding, packaging, designs, and content are the property of YUMIE™ Smart Fuel and may not be used without written consent.
9. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
